These are the general terms and conditions of Team Tandartsen .V. in Amsterdam, registered in the Trade Register of the Chamber of Commerce under number KVK 97225428.
If any provision of these general terms and conditions is void or voidable, this shall not affect the validity of the remaining provisions.
1.1. These general terms and conditions (the "General Terms and Conditions") form an integral part of the treatment agreement pursuant to Article 7:446(1) of the Dutch Civil Code (the "Agreement") between Team Tandartsen its client (the "Client").
1.2. The General Terms and Conditions apply to every treatment Team Tandartsen by Team Tandartsen and every quotation or estimate provided by Team Tandartsen the client.
1.3. The General Terms and Conditions can be made available in writing to the client or his legal representative(s) at the request of or on behalf of the client. In addition, the General Terms and Conditions are available for inspection at the Team Tandartsen clinic Team Tandartsen are published on the Team Tandartsen website.
1.4. Team Tandartsen entitled to amend these General Terms and Conditions at any time.
2.1. Team Tandartsen that the work it performs under this Agreement meets the standards that a good care provider must observe and complies with the legal provisions (including the WGBO) and generally applicable guidelines.
2.2. Dental treatments fall under medical/healthcare treatments. The dentist has an obligation to perform to the best of their ability and not an obligation to achieve a specific result.
2.3. Team Tandartsen entitled to engage third parties in the performance of the Agreement.
2.4. The client must at all times provide Team Tandartsen with Team Tandartsen and truthful information regarding the client's general health and any circumstances that may affect the treatment.
2.5. Any additional costs incurred by Team Tandartsen additional treatment costs arising from the client's failure to provide the requested information and documents necessary for the performance of the Agreement, or from providing them late or in an inadequate manner, shall be borne by the client.
3.1. The costs of dental treatment are claimed in accordance with the applicable UTP rates as determined by the NZa and laid down in the dental care rate decision (www.NZa.nl).
3.2. The dental care price list can be consulted on the Team Tandartsen websites mentioned in the preamble. Prices are subject to change from time to time.
3.3. For all treatments costing a total of EUR 250 or more, Team Tandartsen will provide a quote Team Tandartsen to the treatment.
3.4. If it becomes necessary to change the treatment due to unforeseen complications during the treatment, resulting in the budget being exceeded, the additional costs incurred will be charged to the client after consultation with the client.
3.5. Technical costs will be charged separately. At the request of the client or their insurer, Team Tandartsen will provide a breakdown Team Tandartsen .
3.6. Team Tandartsen may invoice or change Team Tandartsen code retroactively for up to two years after treatment.
4.1. Appointments can be rescheduled or canceled by the client free of charge up to 48 hours before the scheduled time. If the appointment is not rescheduled or canceled in time, Team Tandartsen will charge for Team Tandartsen reserved time and/or agreed treatment with code C90, taking into account the duration of the planned treatment, for which reference is made to the price list that can be found on the websites mentioned in the preamble.
4.2. Team Tandartsen at all times authorized to reschedule or cancel appointments made with the client.
5.1. If, after a treatment agreement has been concluded, a client cancels the treatment in whole or in part, Team Tandartsen is Team Tandartsen to charge the client for all costs incurred by it and by third parties in connection with that treatment.
6.1. Payt handles Team Tandartsen billing for Team Tandartsen . The Payt payment terms and conditions apply to this. The clinic and collects the invoices for the care you have received from us. We naturally comply with all applicable laws and regulations. Our payment terms are in line with the general payment terms for dental care in the Netherlands. These can be found on the website of the KNMT (Royal Dutch Dental Association).
What are the main payment terms for your account with us?
If possible, we may submit your bill to your health insurer. Any reimbursement for the treatment will always be shown on the bill. If you do not want us to submit your bill to your health insurer, you must clearly indicate this to the clinic prior to treatment.
We expect you to pay the invoice before the due date stated on the invoice. If you have not paid the invoice before the due date, you will be in default without further notice of default being required. In the unlikely event that you fail to respond to the free reminder, we will use Payt debt management for an extrajudicial collection process. In that case, statutory interest and collection costs will also be charged.
We strive to keep healthcare costs as low as possible. Avoid increases by paying on time and make as much use as possible of the digital options we offer, such as online payment via iDeal. Also ensure that we always have your current personal and insurance details. This prevents unnecessary delays, costs, and administrative work.
For questions about your invoices, we kindly request that you use digital tools as much as possible. You can respond to your invoice by email by selecting "reply to email" or by using our Payt invoice portal. We will respond as soon as possible.
6.2. If invoices remain unpaid after reminders and the initiation of a collection process, Team Tandartsen is Team Tandartsen to suspend further treatment or to provide it only against direct payment by the client.
7.1. Complaints about the work performed or the invoice must be reported in writing to Team Tandartsen by the client within 30 days of discovery, but no later than three months after completion of the work in question. You can also report a complaint about the invoice online in your Payt environment.
7.2. A complaint as referred to in the first paragraph does not suspend the client's payment obligation.
7.3. In the event of complaints about the invoice, we request that you notify us via the Payt portal. If you have complaints about other matters, we request that you complete the contact form. The complaint will Team Tandartsen handled by Team Tandartsen in accordance with the Complaints Procedure of ZZP Nederland, which is part of the Quasir organization and a member of the disputes body, which is part of the Zorggeschil foundation.
7.4. If a complaint is justified and rectification is possible, Team Tandartsen will still perform Team Tandartsen work as agreed.
8.1. Defective and/or necessary repairs to the workpieces Team Tandartsen by Team Tandartsen , caused by external influences, such as: accident, grinding, medication use, change in the client's health, pregnancy, smoking, use of hormone preparations, osteoporosis, etc., or if the client has not followed the brushing instructions and/or oral hygiene, are excluded from liability.
8.2. Rights to compensation due to liability expire one year after the event causing the damage occurred.
8.3. The client cannot derive any rights from the calculation made by Pien.
8.4. Team Tandartsen not liable for damage to and/or theft of the client's property.
9.1. Team Tandartsen obliged to maintain confidentiality towards third parties who are not involved in the treatment. This confidentiality obligation applies to all information of a confidential nature that has been made available to Team Tandartsen the client.
9.2. The client cannot derive any rights from the calculation made by Zorgsom or Zorgvergoedingencheck.nl.
10.1. All agreements between the client and Team Tandartsen governed by Dutch law.
10.2. All disputes relating to the Agreement between the client and Team Tandartsen, to which these general terms and conditions apply, will be settled by the court in Amsterdam.
